Thank you for standing up to defend New Mexico's ratepayers and impacted communities in the northwestern part of the state. Together we can defeat this dangerous piece of legislation.

In addition to the dozens of organizations that have signed on against this bill, the PRC itself has identified the following issues with this bill:

“Issue 1: Securitization financing, under optimal conditions, should provide cost savings to ratepayers. But the Act, as drafted, may not sufficiently establish separation of the financing entity.

Issue 2: Securitization financing, under optimal conditions, should maximize cost savings to ratepayers. But the Act, as drafted, ensures full recovery of stranded costs without a Commission hearing and participation by affected parties.

Issue 3: Securitization financing, under optimal conditions, should provide cost savings to ratepayers. But the Act, as drafted, lacks certain fundamental ratepayer protections.

Issue 4: Securitization financing, under optimal conditions, should provide cost savings to ratepayers. But without a transparent, independently evaluated RFP process, the utility-ownership mandated in the Act are likely to be controversial and may lead to protracted litigation.”
